The law firm collaborated with the legal office of the “Villa Sofia - Cervello” hospital, in both in and out-of-court judicial phases. It has achieved excellent results both in the criminal proceedings, obtaining an acquittal, and in a purely collaborative phase with the hospital. In addition, we have provided legal advice to the same hospital regarding civil cases.
During the period in which the office assisted the "Villa Sofia - Cervello" hospital, few requests for assistance were accepted by customers for incidents that occurred in relationships with individual facilities or doctors, thus resolving conflicts of interest. In the hypothesis of managing lawsuits involving the QBE or the insured parties, the studio has continued to follow the same policy by not accepting cases representing the other party.
Our law firm has represented or given consultancies to structures, doctors and other medical personnel in force at: Villa Sofia – Cervello Hospital (Palermo), P. Giaccone Polyclinic (Palermo), ARNAS Civic Hospital (Palermo), Vittorio Emanuele Hospital (Catania), Umberto I Hospital (Enna), Papardo Piemonte Hospital (Messina), AOUC Polyclinic (Bari), San Nicola Pellegrino Polyclinic (Trani), Cardarelli Hospital (Napoli), Torre Annunziata Civil Hospital (Torre Annunziata), SS. Giovanni and Paolo Hospital (Venezia), Belcolle Hospital (Viterbo), and many more.
Our procedural case history includes:
- Criminal proceedings for serious culpable injuries to doctors and other medical personnel in force at the “Villa Sofia - Cervello” hospital. In particular, the law firm assisted two surgeons (IG, BF) and two professional nurses (MAM., IL). In a joint and guilty cooperation - as members of the teams carrying out the operations, together with the staff responsible for the cleaning and sterilization of the operating room - the doctors and healthcare workers were accused of causing injury to two minors (GL and BF). The two patients had contracted HCV hepatitis, an incurable disease, during two different surgeries – one for adenoidectomy and one for adenotonsillectomy - at the Villa Sofia hospital in Palermo. After long pre-trial investigation and debate, the trial ended with a verdict of acquittal - aimed at all health workers involved in the affair - because the fact did not constitute a crime.
- Criminal proceedings for serious culpable injury to two doctors and a nurse (LG, PG and LM,) at the "Paolo Giaccone" university hospital in Palermo. In particular, the law firm assisted doctor LG, a senior manager of the UOC at the Department of biomedical internal medicine, as well as a specialist of the Paolo Giaccone Polyclinic. During a hospitalization in the polyclinic, the injured party had contracted the infectious disease of scabies. In addition to the patient (GAM), the prosecution had also identified two of his relatives as injured parties (MR and SG). The proceedings ended with a dismissal order issued by the Judge for the preliminary investigation in Palermo. It was in fact established that the injured party had contracted the disease in a different hospital, where she had been admitted three weeks earlier. Therefore, no responsibility towards the health workers of the Polyclinic was ascertained.
- Civil proceedings were initiated in defense of over 120 parties who had contracted HCV, HBV and HIV hepatitis following transfusions of infected blood and/or ingestion of tainted blood derivatives. After a long preliminary phase, during which 16 of the injured parties were subjected to medical checks by pathologists, the trial ended with a sentence of compensation for damages for a total of over 20 million Euros.
